HIDDEN RIGHTS

In order to live the best life possible, our organization is committed to uncover your hidden rights. If you are unaware of your rights, then you may be impacted not only financially, but physically, mentally, or socially. This is why our current initiative is to make you aware that you (or your child) may be entitled to a 504 Plan which provides accommodations at public schools.

YOUR RIGHT TO A 504 PLAN MAY BE HIDDEN

504 Plan eligibility is a "Hidden" Right. If you are eligible, your school does not have to notify you. You must ask for a 504 Plan and only then, is your school required to set up a meeting with the parent(s) or guardian(s) to establish written accommodations for your child.

Do you know what a 504 Plan is?

A 504 Plan levels the playing field for certain eligible students who have a physical or mental condition. It assures equal access to education by providing accommodations related to safety, academics, environmental conditions, and privacy at your child's school. A 504 Plan is a legal written document between a public school and the parent(s) or guardian(s) of a student who meets the definition of "disability" under Section 504 of the Rehabilitation Act of 1973.

"Disability" is defined broadly as any physical or mental impairment that "substantially limits a major life activity". These major life activities include, but are not limited to, life-sustaining bodily functions (such as the endocrine system, cardiovascular system, neurological system), learning, walking, seeing, and breathing. If a student's disability meets this definition, the student is entitled to Section 504 protection, which mandates that the school comply with the accommodations explicitly set forth in the 504 Plan.

HOW IT WORKS

Schools are NOT REQUIRED to tell you that you are Eligible for a 504 Plan.

YOU MUST ASK FOR ONE

In order for your child to have a 504 Plan, you must request one from your child's school. The school must then set up a meeting to determine the written accommodations applicable to your child. Because Section 504 is a federal law that prohibits discrimination against individuals with disabilities in schools that receive federal assistance, your school must comply with the provisions explicitly set forth in your child's 504 Plan.
